TALKS DEADLOCKED IN DELIVERANCE POKER ISSUE
Posted 3/12/11 : It looks as if the contractual dispute with Mizrachi and Full Tilt will end up being decided in court.
Last year's law suit filed by Deliverance Poker against Michael Mizrachi and Tiltware on contractual breach grounds appears to be headed for the courts despite attempts to negotiate a deal as recommended by the court.
Deliverance Poker is claiming that Mizrachi violated a signed contract by entering into a new deal with Full Tilt Poker, a subsidiary of Tiltware, whilst he still had Deliverance obligations.
Long story short, and circumventing the rather dreary legal moves and counter moves that have been taking place as lawyers on both sides indulge in some legal fencing, Judge James Nowlin of the U.S. District Court for Western Texas urged the parties to mediate their way out of their differences, but this has apparently proved impossible of achievement.
Failing that route, the judge has provisionally set a trial date for April 25.
In a recent development, the Tiltware legal team applied for the case to be dismissed, bringing up the hoary old justification that the court lacks 'subject matter' jurisdiction to hear the case. And if that fails, the company will be looking for more time to address the issue thoroughly.
In the meantime, it appears that the legal manouevring continues, and a mass of documentary evidence is being prepared. It looks like a long haul ahead......
