ARJEL CLAMPS DOWN ON NON-COMPLIANT LICENSEE

Posted by lenny S. on 12/7/10 – Three un-named operators sanctioned by French regulator

The French online gambling regulator, ARJEL has confirmed that it has instituted disciplinary proceedings against three approved operators who remain unnamed.

Upon issuing first recommendations to the operators, ARJEL conducted regular checks and advised where adjustments needed to be made in order for the licensees to operate within the stipulated guidelines.

At the end of this period and under the sanction procedure outlined in Article 43 of Law
No. 2010-476 on openness and competition from gambling and gambling online, ARJEL has put three operators on notice where deficiencies were noted and sent notice of objections to the operators concerned as well as to the Sanctions Committee which is chaired by Thierry Tuot.

The Sanctions Committee will review the objections and decide the outcome in an independent process.  Penalties may include a simple warning, reduction of one year to the term of their accreditation, suspension of registration for three months, the withdrawal of approval or even 5 percent of the total turnover of the last financial year corresponding to the activities.  The determination will be made based on the seriousness of the breaches and the extent of damage and benefits derived from them.

The ARJEL says it participates actively in the fight against illegal sites and claim 125 notices have been sent to non-approved sites which are accessible from France.

To date, the ARJEL has issued 46 licenses to 33 operators.
