Pro NFL Player Pierre Garcon Launches lawsuit against Fanduel

Fourth class action launched against leading daily fantasy sports site.
 
According to a report on Fox Sports a new class action – the fourth against daily fantasy sports operators in the past month – has been launched against FanDuel by Washington professional football player Pierre Garcon.

Garςon alleges in the Maryland filing that player “names and likenesses have been misappropriated” and that FanDuel “knowingly and improperly exploits the popularity” of players at “offensive skilled position” without their permission.
 
Fox published a statement from the footballer which accuses FanDuel of routinely using the names and likenesses of some NFL players "without authorisation to promote FanDuel’s commercial enterprise, collecting huge revenues from entry fees,” and that the DFS operator "continues to promote and to operate its daily fantasy football gaming product on the backs of NFL players."
 
Observers have pointed out that this filing does not also implicate DraftKings, speculating that this may be due to that operator’s business ties with the NFL Players Association, which permits the use of images and names.
