11/19/2012 : FERGUSON FILES MOTION TO DISMISS SAC (Update)
"Factual allegations are strikingly deficient"
Former Full Tilt Director Chris Ferguson's attorney's Harris, O'Brien, St. Laurent & Houteling LLP have submitted a memorandum to the U.S. Courts in support of Howard Lederer's motion to dismiss the verified second amended complaint (SAC) against him saying "the deficiencies in the SAC and the legal arguments asserted by Mr. Lederer, including the recent decision in United States v. DiCristina, No. 11-CR-414, 2012 WL3573895 (E.D.N.Y. Aug. 21, 2012), apply equally to Mr Ferguson.
The memorandum goes on to state that the Government has yet to state a single specific allegation that would result in a claim against Ferguson. "The factual allegations against Mr. Ferguson are strikingly deficient", it said, and as such requests the dismissal of the second amended complaint against Ferguson.
