Difficulty in tracing funds due to insufficient accounting records
Karl Dennis Zanft sole director of Fineform Racing Limited, a company that placed bets predominantly on horse races on behalf of clients at high street and online bookmakers, has been disqualified from running a company for nine years until January 2021 by the UK Insolvency Service's Company Investigation team.
Fineform was placed in liquidation in 2010 owing an estimated GBP 243 961 to creditors.
Zanft failed to ensure that the company maintained proper accounting records during its existence from December 2006 to March 2010 making it impossible to establish whether all the money deposited into the company account were used for placing bets on clients' behalf.
The investigation team concluded that while clients were assured that their deposits would be held in individual accounts – available on request, the payments were channeled into the company's current account and used as general funds.
Claire Entwistle, director of Company Investigations North, commenting on the case said: “This disqualification undertaking represents a successful conclusion to our investigation resulting in Mr Zanft being banned from being involved in the management of any company for several years. The outcome of this case should serve as an important reminder that unacceptable conduct by a company director can result in a lengthy period of disqualification.”
