A tax court in Cologne, Germany is set to decide the tax fate of German poker players with a determination on whether the game of poker is a commercial activity or a game of chance.
 
The court in Cologne is to examine an appeal submitted by an unnamed former poker player, according to Yogonet, who is contesting the tax authorities' demands for tax payments on $1 million received in winnings between 2001 and 2008 saying his success was down to luck.
 
Tax authorities maintain that the winnings stemmed from a commercial activity that uses skill and a deep understanding of the game, rather than labeling poker a game of chance.
 
A decision from the court is expected before year end.
